Nokia asks court to dismiss part of Apple patent lawsuit

How do we know we're years away from a final resolution to the Nokia / Apple patent lawsuit? It's been six months since Nokia first filed its complaint, and the two parties are just now starting to argue about which specific substantive claims they're eventually going to argue about. Let's do a quick refresh: at the heart of the lawsuit is a conflict over Nokia's wireless patents, some of which are almost certainly essential to how cell data and WiFi operate. As a member of the ETSI and the IEEE licensing groups which oversee GSM and WiFi, Nokia's required to license its patents to anyone who asks on fair terms, but those terms aren't set in stone -- Nokia can negotiate separate licenses as it sees fit, and it apparently wanted Apple to cross-license its touchscreen patents as part of the deal. Apple said no, and now we're all in court, with both sides alleging patent infringement in three different lawsuits (one of which is on hold) and Apple claiming that Nokia is also liable for breach of contract, because it promised fair licensing terms and didn't deliver. Got all that? Right.

So that brings us to yesterday, when Nokia asked the court to dismiss all of Apple's contract-related claims, saying that they're simply a distraction from the real issue, which is patents, and that its license offers aren't unfair simply because Apple doesn't like them. In short: Apple and Nokia's patent lawsuit is currently not really about patents at all, but about whether or not it should also be a fight about contract terms in addition to a fight about patents, and that question won't be resolved for months. And that's why ~~vigilante justice is the future of America's tarnished civilization~~ something like 90 percent of patent cases eventually settle out of court.

P.S. Oh, and in case you're wondering, today Reuters reported that the first trial date isn't expected until 2012. So, yeah.

Motorola patent combines multiple devices to make one large display

It seems to us that if you indulge in mobile video from time to time, you're either lugging around a device with a decent display size (netbook, tablet, whatevs) or more likely than not you're watching your Britain's Got Talent! clips on a handset -- either solution is obviously less than ideal. What if we told you that Motorola has filed a patent application for a "Reconfigurable Multiple-Screen Display"? This technology will essentially let you configure multiple devices for use as one big display: Instead of lugging around your Thinkpad or suffering the indignity of watching postage stamp-sized video on your Droid you can simply and conveniently carry four phones around. Why didn't we think of that?

Sony wants to patent 'feature erosion' in game demos, illustrates the idea vividly

Want more evidence of the patent degradation of modern society? Well, here's Sony with its latest idea for selling games. The feature-eroding demo concept gives the user the full game to start off with, but then grows increasingly more limited the more you play it. In racing games, that means the number of tracks you can race on gradually dwindles, whereas in classically themed smack-em-ups like God of War your sword, erm... well, it also dwindles. We're kind of on the fence about this -- on the one hand, it's hilariously insulting to the user as it perpetually nags him about what a cheapskate he is for not purchasing the entire game, and yet on the other it does at least let you taste the full breadth of the game, albeit for a limited time. However you may feel, this is still at the application stage, but given the patent office's recent track record, there's no reason why Sony should be denied the rights over this supposed innovation.

Rambus and NVIDIA patent dispute gets a little closer to a resolution

We're just a few tech-related legal cases away from changing our name to Enpatent, and the latest to push us that little bit closer is yet another ruling in the long and drawn-out battle between Rambus and NVIDIA. If you need a refresher, way back in 2008 Rambus accused NVIDIA of illicitly using five of its patents, and most recently a judge ruled that only three of those five had been violated. Now two more patents have fallen off the legal wagon, with the US Patent and Trademark Office indicating that only one of the three remaining was a true violation, a second was rejected, and a third got a mixed ruling. So, from a start of five Rambus is down to basically one and a half, but NVIDIA is saying it isn't done yet, planning yet another appeal. Maybe we should call ourselves Enappeal instead...

Sony patent application reveals universal, LCD-based game controller

Well, here's a bit of an odd one. A recent patent application from Sony has not only revealed an LCD-based game controller (which would be notable enough in itself), but an LCD-based, universal game controller that's designed to work with more than one game console. As you can see above, the touchscreen would be able to accommodate various buttons and layouts for different consoles -- Sony even curiously mentions consoles like the Amiga CD-32 and Atari Jaguar (for emulation, perhaps?), in addition to Microsoft and Nintendo -- and the screen itself would be housed in what Sony describes as a "game controller skin." Of course, this is still just an application for a patent, and we're pretty sure Sony is focused on another controller at the moment.

Latest Apple patent app details multitouch tactile keyboard

We're not going so far as to suggest that this here patent application foreshadows the kind of keyboard that'll be on a certain Apple tablet that may or may not be real, but if the suits in Cupertino do actually have such a device in the works, they'd be silly to not apply this technology to it. Dug up by Apple Insider, the latest app details a multitouch tactile keyboard that would boast a dynamic surface for helping typists keep track of where they're at on the board. Essentially, the surface would utilize an "articulating frame" in order to raise and retract bumps to make typing without physical keys a wee bit easier, and while we're certain that it would take some getting used to, it's bound to be simpler than banging on a static surface that requires your eyes to be on it. Don't go getting your hopes up, though -- wouldn't want to get them crushed when late January brings you an iPod touch with a camera, now would you?

Microsoft's $358 million damage award overturned, Alcatel-Lucent likely perturbed

We won't go so far as to compare this to the epic multi-year Broadcom vs. Qualcomm saga, but this is certainly shaping up to be the case that never ends, part II. Microsoft and Alcatel-Lucent have been at each other's throats over various things since August of 2007, and while we've seen damages awarded and overturned a few times since, the latest ruling to be handed down by the US Court of Appeals for the Federal Circuit has A-L waiting a wee bit longer to get its (maybe) due. This past Friday, the court decided that while a $358 million damages award against Microsoft for "violating patents relating to technology that allows users to enter dates into calendars in its Outlook e-mail program" was somewhat legitimate, the damages were "unjustified." The result? The whole thing has to be retried, giving the contracted law firms for both companies immense joy.

TiVo awarded $200m in damages in EchoStar case, consumers not awarded end to the Echostar case

Okay, so it's not the cool billion dollars in damages we'd heard TiVo was asking for, but $200 million ain't chump change if you're broke, you know? That's the amount in contempt damages TiVo will get if EchoStar loses its upcoming appeal in the endless time warp patent case, bringing the total amount of money on the table to nearly $400 million. As usual, that means virtually nothing for the average Dish or TiVo customer, but at least the lawyers involved can all buy new Audis for the winter now.

Microsoft Word allowed to stay on sale... for now

Just as we predicted, Microsoft's request to have that ban on sales of Word put on hold pending appeal of i4i's XML patent victory has been granted. That means IT managers and excitable first-year college students can continue to happily throw down cash for the world's most popular word processor, while the rest of us twiddle our thumbs waiting for either proceedings to resume on September 23 or Stevey Ballms to write the big check and make this whole case disappear forever.

Discovery Communications patents e-book reader, why not?

Let's face it, at this point everyone is looking to get in on the e-book reader action. Back in February, broadcast television group Discovery Communication -- known for BBC America, Travel Channel, TLC, and Discovery Channel, naturally -- filed a patent for its own digital book reader back in February that's now surfacing online. There isn't a lot of concrete detail here, other than it runs the gamut of possible distribution options, including public libraries à la Sony's Daily Edition. In the picture above we've got hints of Cos News Services and US News and World Report, but that could very likely just be filler for the filing. It won't be nothing without partners, but if Discovery's serious, we're sure they've got a few phone numbers to call up and try to make a deal with.

TiVo projects larger than expected losses, still taking the patent fight to AT&T and Verizon

We'll let the analysts make sense of TiVo's new projection that it will lose $8 to $10 million in the third quarter, larger than Wall Street expectations while projected revenues are lower -- we're too busy adding Verizon and AT&T to the patent battlemap. Today it filed complaints against both for violating three of its DVR-related patents -- Nos. 6,233,389 B1 ("Multimedia Time Warping System"), 7,529,465 B2 ("System for Time Shifting Multimedia Content Streams"), and 7,493,015 B1 ("Automatic Playback Overshoot Correction System") if you must know -- seeking damages for past infringement and a permanent injunction. We'd assumed it would wait until settling things with DISH to push forward against other companies, but it looks like we're not the only ones getting impatient. Beyond the legal slapfight there's a few nuggets for the bleep bloop faithful, with the Comcast TiVo on-line scheduler beginning to roll out in Boston plus further expansions on the way and the due-in-2010 DirecTV HD TiVo still on track -- we'll need a few seasons of Law & Order queued up before this mess ever gets resolved.

Nintendo KIRFs Nerf with soft football patent attempt

Ready for your daily dose of absurdity? Nintendo has filed for patent protection of yet another inflatable idea, this time throwing up a spongy football accoutrement for your Wiimote. The "ball" has a strap to keep you from actually throwing it, and in-game trajectories are calculated on the basis of the angle and force of your pseudo-throwing motion. If you're thinking the Wiimote can do all this even without a plush attachment, you'd be right, but then you'd just look silly jumping and juking in front of your TV without a proper accessory in hand.

Nokia / InterDigital patent drama continues with ITC ruling in Espoo's favor

Corporate legal teams are so large, so powerful, and often so evenly-matched that when you combine them with the glacial wheels of justice, patent disputes can take years to resolve -- in fact, we'd say it's the rule rather than the exception -- and inevitably, they end in anticlimactic fashion with the alleged offender agreeing to shell out some fraction of the plaintiff's original request in exchange for sweeping the whole matter under the rug. Nokia's had its fair share of such spats, and one that's been dogging the company for a good long while now is with InterDigital, which has been systematically targeting firms in the industry for years with claims that it holds patents inherently required for UMTS -- in other words, if you make UMTS gear, you automatically owe InterDigital money. Of course, Nokia has been politely disagreeing with that claim all along, and the US International Trade Commission has just issued an initial determination in its favor, saying that it doesn't violate the four patents InterDigital's all worked up over. For the record, the US ITC has been investigating this issue for a solid two years now, so yeah, if someone's ripping off your IP, don't expect a speedy resolution. The commission's initial determination will be followed by a final, binding determination this December; in the meantime; Espoo "will continue to present its case." Now that we think about it, we're pretty sure we saw this episode of Law & Order already.

HTC files patent for capacitive stylus with resistive accuracy

Though capacitive displays are generally regarded as the easier-to-use technology for mobile touchscreens, their finger-friendliness comes at a dear price: accuracy. Because capacitive tech is incompatible with traditional styli, you're stuck fudging things with your fat digits or settling for a high-tech finger alternative that arguably creates as many problems as it solves. Don't worry, though -- HTC feels your pain, and it seems like they're looking to keep the classic stylus in the game as the company's lineup makes the inevitable transition to capacitive over the coming years. A new patent application describes a stylus with some sort of magnetically charged tip -- at first, we thought that sounded suspiciously like what Wacom does for its tablets, but unlike Wacom's tech, this would function with a traditional, seemingly unmodified capacitive display. It's funny how we've all written off styli in the past couple years and now we've got HTC over here doing everything it can to save 'em -- but hey, if this means we're going to get the best of both worlds, we're all for it.

Microsoft forbidden from selling Word, will probably keep selling Word

Hey, remember that seemingly random patent case from May in which a federal jury awarded a company called i4i Ltd $200 million in patent damages against Microsoft? Things just got worse for Redmond: the judge in the case today issued a permanent injunction against sales of Word 2003, Word 2007, and any future versions of Word that can open .xml, .docx, or .docm files containing "custom XML." Yeah, no kidding -- that's pretty much all of 'em. At issue is i4i's patent on a method for reading XML, and obviously Microsoft's vowed to appeal, so expect this injunction to be stayed pending that appeal in short order -- and also expect Microsoft to eventually either find a way to win or simply pay up, since there's no way it'll let anyone kill Word. We'll see what happens. Word.

Nintendo patent filing reveals inflatable cushion controller for horse riding, shark jumping

Creative patent filing reveals drag and drop interface with "action tabs"

Creative's made itself pretty well acquainted with the FCC as of late, and it looks like it's also been doing its part to keep the old Patent and Trademark Office busy as well, with a recently revealed application showing off some plans for a drag and drop touchscreen interface. That's obviously somewhat of a tricky area to patent, but it seems that Creative's big new idea is something called "action tabs" that could be used for something as simple as tabbed web browsing, but would apparently also be applied to other OS elements as well -- letting you drag something to the clipboard, for instance, or drag a photo to an action item of some sort. Just as interesting as the patent itself, however, is the fact that it's assigned to Creative subsidiary 3DLABS, now known as ZiiLABS, makers of the touchscreen-based Zii EGG. Like we said, interesting.

Apple patent application promises means to detect gadget abuse

Apple's already put liquid submersion sensors in some of its recent products, but a recent patent application seems to suggest that it has some considerably grander plans in mind to detect and prevent gadget abuse. Described as a "Consumer Abuse Detection System and Method," the new system would apparently make use of a whole range of sensors to various issues that might void the warranty of the device, like exposure to extreme cold or heat, drops, or submersion in liquid. What's more, unlike the current liquid sensors that simply change color when something bad happens, the new system would apparently store the damage digitally in memory which, presumably, wouldn't be as susceptible to damage as the device itself. The system would also apparently do its best to protect the devices by disabling them if it detects some imminent danger, although Apple doesn't make any bones about the fact that it's primarily designed to save money on returned products that have been abused by the user.

RIM patent filing reveals hybrid capacitive / resistive touchscreens

RIM's no stranger to playing different tricks with touchscreens, and it looks like it may have another up its sleeve, with a recent patent application revealing some plans for a hybrid capacitive / resistive touchscreen. As you might expect, the idea here is to take the best aspects from each and form one super touchscreen, which would have the general usability and "goodness" of capacitive displays, and the added benefits of a resistive screen, like better support for stylus-based input. Of course, such a screen would also likely eliminate one of the biggest advantages of resistive displays -- their cost-effectiveness -- so it seems safe to assume that it'd be reserved for higher-end phones to start with.

Patent Office rejects some of TiVo's patent claims, battle vs. DISH to rage on

You knew it couldn't be over, right? The long running TiVo vs. DISH / Echostar patent case took a not-so-new twist yesterday when the Patent and Trademark Office issued a preliminary finding rejecting some of the claims of its Time Warp patent. While DISH was pleased, considering the PTO's conclusions as "highly relevant" to its ongoing appeal, TiVo issued a statement calling this step "not unusual" pointing out that the exact same thing happened when its patent was reexamined in 2005 (and subsequently upheld in 2007,) and that the next step in the process is where it will be able to present its explanation for the first time. All you need to know is that it will still be a while before anyone involved (except the two company's lawyers) are cashing any large checks, or gets their DVR taken away.
